Dari ‘Imran bin Hushain bahwa ia pernah ditanya tentang laki-laki yang menthalaq istrinya kemudian ia tetap mencampurinya, sedang ia ketika menthalaq itu tidak ada saksinya, demikian pula rujuknya. Kemudian ia menjawab, “Kamu menthalaq tidak menurut sunnah (Nabi) dan merujuk (juga) tidak menurut sunnah. Adakanlah saksi ketika menthalaq dan merujuk dan janganlah kamu ulangi (perbuatan seperti itu). [HR. Abu Dawud dan Ibnu Majah, sedang Ibnu Majah tidak berakata, “Jangan kamu ulangi”.]

Dari ‘Aisyah, ia berkata : Istri Rifa’ah Al-Quradhiy pernah datang kepada Nabi SAW, lalu berkata, “Aku fulu menjadi istri Rifa’ah, kemudian ia menthalaqku thalaq tiga, kemudian sesudah itu aku kawin dengan ‘Abdurrahman bin Zubair, sedang apa yang ada padanya seperti ujung pakaian”. Kemudian Nabi SAW bertanya, “Apakah kamu ingin kembali kepada Rifa’ah ? Tidak boleh, sehingga kamu merasakan madunya dan dia merasakan madumu”. [HR. Jama’ah]

Dari ‘Aisyah bahwa sesungguhnya Nabi SAW bersabda, “Yang dimaksud madu itu ialah jima’ “. [HR. Ahmad dan Nasai]
Keterangan :
1. Bekas istri yang boleh dirujuki adalah yang baru dithalaq dua kali.
2. Bekas istri yang sudah dithalaq tiga kali tidak boleh dirujuki, kecuali apabila bekas istri tadi sudah kawin dengan laki-laki lain dan sudah dikumpuli, kemudian dithalaq oleh suami yang kedua tersebut dan sesudah habis masa ‘iddahnya.
3. Adapun cara rujuk adalah dengan nikah lagi, dengan alasan karena ikatan nikah yang dulu sudah putus karena thalaq. Namun demikian ada pula ulama yang berpendapat apabila rujuknya itu masih di dalam masa ‘iddah, tidak perlu dengan nikah lagi, dengan alasan “Dan suaminya berhak merujukinya dalam masa menanti itu, jika mereka (para suami) itu menghendaki ishlah”. Information :
1. Former wife who may dirujuki is newly dithalaq twice.
2. The ex-wife is already dithalaq three times should not be dirujuki, unless ex-wife had been married to another man and had dikumpuli, then dithalaq by which both the husband and after the expiration of the 'iddahnya.
3. The way of reconciliation is to get married again, with the reason for the marriage tie that had already dropped out because of talaq.
