Daraus leitet sich der Grundsatz ab, dass die Grundrechte in erster Linie als Abwehrrechte des Bürgers gegen den Staat zu verstehen sind, während sie weiterhin auch eine objektive Wertordnung verkörpern, die als verfassungsrechtliche Grundentscheidung für alle Bereiche des Rechts gilt. Die soziale und politische Struktur der staatlich verfassten Gesellschaft wird damit verfassungsrechtlich festgelegt. Das Bundesverfassungsgericht bewahrt als unabhängiges Verfassungsorgan die Funktion der Grundrechte, das politische und staatsorganisatorische System und entwickelt sie weiter.
